Terms of Service
Effective date: [TODO: launch date] · Last updated: October 17, 2026
These Terms govern your use of the BidDuty website and newsletter (the "Service"). BidDuty is operated by [TODO: legal name of operator] ("BidDuty," "we," "us"). By subscribing or using the Service, you agree to these Terms.
1. What BidDuty is
BidDuty is an information service. It summarizes publicly posted government bid opportunities and links to the official notices. BidDuty is not affiliated with, endorsed by, or acting on behalf of any government agency, including SAM.gov, the U.S. General Services Administration, the State of Texas, or any city, county or other public entity.
2. No guarantee of completeness or accuracy
We work to be accurate, but bid information changes often, and agencies amend, extend or cancel solicitations. We don't guarantee that the Service lists every opportunity, or that any summary, date, set-aside or requirement is complete, current or correct. The official solicitation always controls. You are responsible for reading it, confirming deadlines and eligibility, and deciding whether to bid. We don't guarantee that you will win any contract or earn any revenue.
3. Your account and subscription
- You must be at least 18 and able to enter a contract. If you subscribe on behalf of a company, you confirm you're authorized to do so.
- Give us an accurate email address and keep it up to date.
- Paid plans are for your own business. Don't resell, republish or redistribute the newsletter content in bulk without our written permission. Forwarding an occasional issue to a coworker is fine.
4. Plans, billing and cancellation
- Free: the weekly sample is free. We may change or end the free sample at any time.
- Paid plans (currently Basic at $29/month or $290/year, and Bid-Ready at $79/month) are billed in advance through Stripe and renew automatically at the end of each billing period until you cancel.
- Cancel anytime using the unsubscribe or manage-subscription link in any email, or by emailing hello@bidduty.com. Cancelling stops future renewals. You keep paid access until the end of the current period.
- Refunds: [TODO: choose a policy, e.g., "If you're not happy within 14 days of your first paid charge, email us for a full refund. Otherwise payments are non-refundable except where required by law."]
- Price changes: we'll give at least 30 days' email notice before a price change affects your next renewal.
- Prices are in U.S. dollars and don't include any taxes that may apply.
5. Acceptable use
Don't misuse the Service. That includes trying to access it without authorization, interfering with its operation, scraping or bulk-copying it, or using it for anything unlawful.
6. Intellectual property
The underlying government notices are public. BidDuty's selection, organization, summaries, notes, name and logo belong to us. We grant you a personal, non-transferable license to read and use the newsletter for your own business.
7. Third-party links and services
The Service links to government websites and uses third-party providers (such as Buttondown for email and Stripe for payments). We don't control those sites or services and aren't responsible for them.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BIDDUTY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST BIDS OR LOST BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $50 IF YOU PAID NOTHING.
10. Changes and termination
We may update these Terms. We'll post the new version here, and if a change is material we'll notify subscribers by email. We may suspend or end access for anyone who violates these Terms. You may stop using the Service at any time.
11. Governing law
These Terms are governed by the laws of [TODO: state], without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in [TODO: county, state], unless applicable law requires otherwise.
